General Terms and Conditions – GTC

  1. Scope of Application – Contracting Partner – Definitions

These general Terms and Conditions (GTC) shall apply to any further education offers – hereinafter the „Education Measure“ – of Martin Mantz GmbH – hereinafter also the „Organizer“.

By his registration, the participant accepts these GTC.

Deviating, contrary or supplementary general terms and conditions of the participant shall not apply, except if we expressly agree to their application.

 

  1. Registration – Conclusion of Contract

The seminar dates are a schedule preview for the Education Measures. A participant can sign up for these Education Measures with the Organizer via the registration form.

Registrations will be considered in the order received. There is no general claim to participation. Organizer reserves the right to determine admission on a case by case basis.

The participant will receive a booking confirmation after the booking has been received.

We will accept the registration within 14 calendar days, in writing or in text form.

 

  1. Costs

The seminar fees are given including the respective applicable VAT.

Costs for teaching materials are included in the seminar price unless something different has been expressly agreed.

 

  1. Payment Terms – Off-Setting/Retention

The seminar fees shall be due within 7 days of receipt of the invoice and shall be paid with reference to the invoice number.

 

  1. Cancellation of Registrations – Transfer of Participation

Registrations must be cancelled in writing. Cancellation is possible at any time, and free of charge until four weeks (determined by receipt by the Organizer) before the event commences.

If not cancelled in time or in the proper form, or if the participant does not attend, the full seminar fee per event and person shall be charged.

The participant shall have the right to prove that Organizer incurred no damage or a lower damage.

If a participant is unable to attend, he may designate a replacement for the entire event, provided that the Education Measure has not commenced yet and the replacement participant meets the prerequisites for admission. A new confirmation or invoice to the replacement participant will not be issued

An existing revocation right shall take priority over the determination of a replacement participant.

 

  1. Revocation Policy

Revocation Rights

You have the right to revoke this contract within fourteen days, without giving reasons.

The revocation period shall be fourteen days from the day of conclusion of the contract.

about your decision to revoke this contract by clear declaration (e.g. a letter sent by mail, telefax or email). To comply with the revocation period, it shall be sufficient if you dispatch the notification of your exercise of the revocation right before the expiration of the revocation period.

 

Consequences of Revocation

If you revoke this contract, we shall return all payments that we have received from you without delay and no later than within fourteen days from the day on which we receive your notification on revocation of this contract. For this revocation, we use the same means of payment that you have used in the original transaction, except if we have expressly agreed something different; in no case shall we charge any fees for this repayment.

If you have demanded that the services commence before the end of the revocation period, you shall be liable for paying an appropriate amount corresponding to the share of the services already rendered by the time at which you inform us that you are exercising your revocation right concerning this contract, as compared to the overall scope of the services stipulated in the contract.

Special note: Your revocation right shall expire early if the contract is completely met upon the explicit wish of both parties before you have exercised your revocation right.

 

  1. Cancellation of Events

Organizer reserves the right to cancel or reschedule Education Measures that have been announced or already commenced due to lack of participants or withdrawal/illness of the lecturer or for any other important reasons that are not due to Organizer’s fault, such as force majeure.

The participants will be informed about the cancellation or rescheduling of the event without undue delay. Already-paid participation fees will be reimbursed immediately in case of cancellation.

If the minimum number of participants is not reached, Organizer reserves the right to convert the Education Measure into small-group coaching or individual coaching.

 

  1. Reservation of Changes

Organizer reserves the right to replace lecturers and/or reschedule or change the program sequence, provided that this does not fundamentally change the objective of the event.

There is no claim to having the event held by a specific lecturer. Organizer shall have the right to replace the intended lecturers with other people with corresponding qualifications for the announced subject. In doubt, Organizer shall render evidence of such qualification.

Organizer shall have the right to adjust the content of the Education Measure to the respective current scientific findings and to make method changes to the event for this reason as well, as far as this does not fundamentally change the overall character of the announced event.

Content modifications that change the objective of the course are permitted if they take place with the consent or upon the request of the offices in charge of recognizing the intended degrees.

The order and quantity of the contents may vary depending on group size and group dynamics. This ensures the greatest possible implementation of the contents in practice.

Organizer reserves the right to change the seminar location. The registered participants will be informed about any required changes without undue delay.

 

  1. Obligations of the Participant

The participant commits to observe the house rules applicable at the seminar site.

The participant is obligated to comply with the instructions of the lecturers and the officers of Organizer and its vicarious agents.

The participant is obligated to not do anything that may be contrary to the proper execution of the Education Measure.

 

  1. Copyright Law

The documents provided to the participant and any other media provided for the purpose of the course are protected by copyright. Reproduction, disclosure, public presentation or any other use of the provided documents/media – even in excerpts – shall only be permitted with the explicit written consent of Organizer.
